Terms of Service

OriKcal is not a medical service. It is a food-logging tool. It does not
diagnose, treat, cure, or prevent any condition, and nothing in it is medical or dietetic
advice. Always consult a qualified healthcare professional before changing how you eat,
especially if you have a medical condition, are pregnant or breastfeeding, are under 18, or
have any history of disordered eating.
1. Agreement
These Terms are a binding agreement between you and [LEGAL ENTITY NAME]
("OriKcal", "we", "us"), covering your use of the OriKcal application and website.
By creating an account, ticking the acceptance box, or using OriKcal, you confirm that you
have read, understood, and agree to these Terms and to our Privacy Policy. If you do not agree,
do not create an account and do not use the service.
You must be at least 18 years old to create an account. If you are under 18,
do not use OriKcal.
2. Health disclaimer
This is the most important section of these Terms. Please read it in full.
- OriKcal is a general wellness and food-logging tool. It is not a medical
device, not a healthcare service, and not a substitute for professional advice.
- Calorie targets, TDEE figures, macronutrient splits, and any suggestions produced by the
app or its AI assistant are general estimates generated from formulas and
statistical models. They are not personalised medical or dietetic advice and take no account
of your medical history, medication, allergies, or clinical needs.
- The TDEE figure is calculated using the Mifflin–St Jeor equation, a population-level
estimate. Your actual energy needs may differ significantly.
- Consult a doctor or registered dietitian before acting on anything in OriKcal,
and particularly before starting any calorie deficit, if you have diabetes, heart disease,
kidney or liver conditions, high blood pressure, thyroid conditions, are pregnant or
breastfeeding, are recovering from illness or surgery, or take any prescribed medication.
- Never disregard professional medical advice, or delay seeking it, because of something you
read in OriKcal.
- If you feel unwell while using the app, stop and seek medical attention.
3. Disordered eating
Calorie tracking is not appropriate for everyone. If you have, or have previously had, an
eating disorder or a difficult relationship with food or your body, tracking can be harmful.
Please speak to a healthcare professional before using OriKcal, and stop using it if it is
affecting your wellbeing.
If you are struggling, contact a local eating disorder helpline or your doctor. OriKcal is
not a crisis service and cannot provide support of that kind.
4. Accuracy of estimates
OriKcal uses artificial intelligence to estimate the nutritional content of meals you describe,
speak, or photograph. These are estimates and they will sometimes be wrong.
- AI may misidentify foods, misjudge portion sizes, miss ingredients that are not visible
(oils, butter, sugar, sauces), or return figures that are materially inaccurate.
- Every estimate is shown with a confidence indicator and every value can be edited
by you before it is saved. You are responsible for reviewing figures before relying
on them.
- Do not rely on OriKcal for any purpose where inaccuracy could cause harm — including but
not limited to insulin dosing, managing a medically prescribed diet, allergen avoidance, or
any clinical decision.
- OriKcal must never be used to determine medication doses. If you take
insulin or any dose that depends on carbohydrate or calorie intake, follow the counting
method your healthcare team gave you.
- Nutritional information is derived from general food composition data and may not match
the specific product, recipe, or preparation you consumed.
5. Results and imagery
- We make no promise of any specific result. Weight, body composition, and
health outcomes depend on many factors outside our control, including genetics, medical
conditions, medication, sleep, stress, activity, and adherence.
- Individual results vary. Any result described or depicted anywhere in our app, website,
advertising, or social media is illustrative and not a guarantee or typical result.
- Some imagery used in our marketing is illustrative or computer-generated and does not depict
identifiable OriKcal customers or verified outcomes.
- Testimonials reflect individual experience and are not representative of what you should
expect.
6. How your data reaches our AI
To analyse a meal, the text you type, the audio transcript of what you say, or the photo you
take is transmitted to a third-party AI provider for processing. By using these features you
consent to that transmission.
- Only send photos you are comfortable transmitting. Avoid capturing other people, documents,
or anything sensitive in the background of a meal photo.
- Do not enter personal health information, identifiers, or anything confidential into the
chat or meal description fields.
- Our handling of your data is described in the Privacy Policy.
7. Your account
- You are responsible for keeping your password secure and for all activity under your account.
- One account per person. Do not share your account or resell access.
- Provide accurate information. Inaccurate details (age, weight, height, activity level) will
produce inaccurate targets.
- Tell us immediately at support@orikcal.com if you
believe your account has been accessed without permission.
- You may delete your account at any time. We may suspend or terminate accounts that breach
these Terms.
8. Subscriptions and billing
- OriKcal is a paid subscription service. Access requires an active subscription.
- Plans are offered monthly, quarterly, and annually at the prices displayed at the time of
purchase. Prices may change; changes will not affect your current billing period.
- Subscriptions renew automatically at the end of each billing period unless
cancelled beforehand.
- You may cancel at any time. Cancellation stops future charges; access continues until the
end of the period you have already paid for.
- Except where the guarantee in section 9 applies, or where a refund is required by the
consumer law that applies to you, payments are non-refundable.
- Payments are processed by Stripe. We do not receive or store your full card details.
9. The yearly guarantee
Annual subscribers may qualify for a full refund of the annual fee under the following terms.
- The condition: you must log at least one meal on [NUMBER]
separate days within the 12-month subscription period, as recorded in your OriKcal account.
- How to claim: email support@orikcal.com
within [NUMBER] days of the end of your 12-month period, from the address on
your account.
- Eligibility is determined solely by the logging records held in your OriKcal account.
- The refund is of the annual subscription fee actually paid. It applies once per person, to a
first annual term only.
- Approved refunds are returned to the original payment method, typically within 14 days.
- Accounts found to be logging fraudulently or automatically are not eligible.
- Service interruptions. If OriKcal was unavailable for all or part of a day
because of an outage affecting us or one of our providers, that day is excluded from the count
rather than counted against you. Equally, downtime on its own does not entitle you to a refund
under this guarantee — eligibility depends on your logging record over the days the service
was available.
- We may withdraw or change this offer for future subscribers at any time. Any change will not
affect a guarantee you have already started.
- This guarantee is offered in addition to, and does not limit, any rights you have under the
consumer law that applies to you.
10. Acceptable use
You agree not to misuse the service, including by attempting to access other users' data,
reverse engineering the app, scraping or bulk-extracting content, overloading our systems, using
automated tools to generate activity, or using OriKcal for any unlawful purpose.
11. Availability and third-party services
We aim to keep OriKcal available but do not guarantee uninterrupted service. Features may
change, and the service depends on third parties (hosting, database, payment, and AI providers)
whose outages may affect it. We are not liable for interruptions outside our reasonable control.
Third-party failures
OriKcal relies on independent providers for hosting, data storage, payment processing, and AI
analysis. When one of them fails, the app may be slow, unavailable, or unable to save or analyse
a meal.
- We are not responsible for outages, delays, data loss, failed payments, or degraded
performance caused by a third-party provider, by your internet connection or device, or by
any other event outside our reasonable control.
- A promotional offer or guarantee cannot be claimed on the basis of downtime alone.
Service interruptions do not by themselves create an entitlement to a refund, a credit, an
extension, or compensation.
- Where an interruption prevents you from using OriKcal for a meaningful period, we may at our
discretion extend your subscription by an equivalent period. This is a discretionary remedy,
not an obligation.
- If a payment fails, is duplicated, or is delayed by the payment provider, we will help you
resolve it with that provider, but the provider's own terms govern the transaction.
None of this limits any right you have under the consumer law that applies to you, including
any right to a remedy where a service is not supplied as agreed.
12. Limitation of liability
To the fullest extent permitted by law:
- OriKcal is provided "as is" and "as available", without
warranties of any kind, express or implied, including fitness for a particular purpose.
- We are not liable for any health outcome, injury, illness, weight change, or loss arising
from your use of, or reliance on, OriKcal or any estimate it produces.
- We are not liable for indirect, incidental, special, or consequential losses, or for loss of
data, profit, or goodwill.
- Where liability cannot lawfully be excluded, our total aggregate liability is limited to the
amount you paid us in the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes liability for death or personal injury caused by our
negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a
consumer, you keep all rights your local consumer law gives you, and nothing here overrides them.
13. Changes to these terms
We may update these Terms. If we make a material change we will notify you in the app or by
email and, where required, ask you to accept the new version. Continuing to use OriKcal after
changes take effect means you accept them.
14. Governing law
These Terms are governed by the laws of [JURISDICTION], and the courts of
[JURISDICTION] have jurisdiction. If you are a consumer resident elsewhere, this
does not deprive you of the protection of the mandatory consumer laws of your country of
residence.
